Terms of supply and installation

1. What these terms are
These terms apply when we supply and install an access ramp or related access product for you. Together with your quote, they are our agreement.
Your quote wins. Where anything in your quote differs from these terms, the quote applies.
2. Quotes
An indicative price given from photographs and measurements you have supplied is an estimate, not a quote. We give these free because they help you work out early whether a ramp is worth pursuing. They are based on what you have told us and we have not seen the site.
A quote issued after a site inspection is a firm price for the scope described in it.
Quotes are valid for 30 days unless the quote says otherwise.
3. Site inspection
We measure and assess the site before issuing a firm quote. Photographs are enough for a ballpark and are not enough to order from.
The inspection fee is $399 including GST for sites in the Melbourne metropolitan area. Outside metro Melbourne, we quote it before attending.
If you proceed with the work, the fee is credited in full to your order. The credit holds for 30 days from the inspection.
4. Prices and GST
Prices we give you include GST where GST applies. Some access products can be GST-free, so not every line on a job attracts it. Your quote shows the total you pay.
Prices are in Australian dollars.
5. Payment
Ramp orders: 50 per cent deposit on acceptance, balance on completion. We order the ramp once the deposit is received. Nothing is manufactured before then.
Other products (tactile indicators, stair nosings, handrails, thresholds): where supplied as part of a ramp order, the same deposit and balance apply. Supplied on their own, payable on completion.
Invoices are payable by bank transfer. We do not take card payments.
6. What we do and do not include
Your quote lists what is included. It is the definitive scope, not this section.
Unless your quote says otherwise, we do not include:
- Concrete, paving, footings or civil work
- Modifications to existing decks, doors, door frames or structures
- Council permits, approvals or certification
- Electrical, plumbing, drainage or landscaping work
- Removal or relocation of existing steps, handrails or structures
- Structural work to the building
- Repair of pre-existing defects
If we find something at the inspection that changes the scope, we tell you before you commit, not after.
7. What we need from you
- Access to the site on the agreed day, and somewhere to unload.
- Permission to do the work. If you rent, or the property is owned by someone else, or a body corporate is involved, you need their written consent and we may ask to see it.
- Accurate information about the site, including anything below ground. We make a Dial Before You Dig enquiry where we are penetrating the ground, but you should tell us what you know about services, pipes and cables.
- Somewhere safe for the ramp components if they arrive before installation day.
If we attend and cannot work because access is not available, we may charge a reasonable call-out.
8. Timing
We will tell you what the manufacturer or supplier tells us about manufacture and delivery, and it is an estimate. Modular ramp systems are made to order in New South Wales and freighted to Victoria. Other products are supplied from our suppliers' stock. Both are outside our control.
What we commit to is telling you promptly when something changes, rather than letting a date slide quietly.
If you are working to a hard deadline, tell us before you order.
9. Changing or cancelling your order
Before a ramp order is placed: you may cancel at any time. We refund your deposit less any inspection fee and any work already done at your request.
Once a ramp order's deposit is paid, the ramp is ordered and manufacture begins. From that point, the order cannot be cancelled or returned because of a change of mind, and we cannot refund the cost of the product.
Other products, supplied from stock, can be cancelled any time before they are ordered on your behalf.
We are telling you this plainly because it is the point of no return for a ramp order. The moment to raise a doubt is before you accept.
None of this affects your rights if something is faulty or is not what we agreed. See section 12.
Variations you request after acceptance are quoted and agreed in writing before we do them.
10. Title and risk
Ownership of the goods passes to you when we have been paid in full.
Risk passes to you on completion of installation. Until then, damage to the goods is ours, unless it is caused by you or someone at the site.
11. Warranties
Two separate things:
The product is covered by the manufacturer's warranty. We provide their warranty documentation at handover.
Our installation is covered by our 24 month workmanship guarantee, which is a separate document and forms part of this agreement. Labour is covered anywhere we install in Victoria. For sites outside the Melbourne metropolitan area, travel is charged at our published travel rates.
12. Your rights under the Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled: to cancel your service contract with us; and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.
Nothing in these terms limits, excludes or modifies those rights. Where anything here conflicts with the Australian Consumer Law, the law applies.
13. What we do not do
We are carpenters and installation contractors. We are not registered building practitioners. We do not carry out structural building work, bathroom modifications or level entry showers.
We do not certify compliance. No installer can certify that a ramp is compliant in the abstract, because it depends on the finished configuration, the site, and in some cases a building approval or project specific engineering.
RampAssist modular access ramps can be configured to meet applicable accessibility requirements, subject to site conditions, final design, installation and any required building approval, certification or project-specific engineering.
Where your occupational therapist has specified a gradient, a landing or a handrail arrangement, we build to it. That is their clinical judgement and we do not overrule it or substitute our own.
14. Privacy
We handle your information in accordance with our privacy policy, including health related information provided by you or by your occupational therapist.

16. General
These terms are governed by the law of Victoria.
If any part of these terms is found to be unenforceable, the rest continues to apply.
